Orders

The following terms and conditions listed below will apply between you and SoundArt UK Ltd for the sale and purchase of the items contained in your basket. The terms do not affect your statutory rights.

All orders are subject to acceptance and product availability. SoundArt UK Limited prides itself on accuracy and aims to ensure that the pricing of products on the web pages are correct at all times, however, the web pages may not accurately reflect the correct details at the moment at which you place your order. SoundArt UK Ltd cannot confirm the price of a product until your order is accepted on despatch and SoundArt UK Ltd reserves the right to change prices without prior notice.

Validity

By ordering a product you accept these terms and conditions. The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes.

Pricing and Currency

The total cost of your order reflects the price of the items ordered plus a shipping charge for handling, packing and standard postage within mainland UK.

All products are priced in pounds sterling (£), Value Added Tax where applicable is shown at the prevailing rate in the Checkout. Where the products ordered are to be delivered outside of mainland United Kingdom the relevant additional cost will be identified in the checkout process prior to your order confirmation.

Availability of Goods and prices

All items are despatched within 28 days from the receipt of cleared funds that match the amount of your order in pounds sterling £. If SoundArt UK Ltd has insufficient stock to deliver the goods you have ordered. SoundArt UK Ltd will inform you by e-mail at the address given in your order form and any sum which may have been credited from your credit card will be re-credited to you within 30 days of the date of your order.
Your undertakings and warranties

You warrant that the information given on your order form is complete and accurate.

Acknowledgement of Order

When you have completed your order you will be sent an e-mail confirming your order. It will state what the products are, the cost (including VAT and P&P) and delivery and invoice details. If your order has been unsuccessful you will be made aware of the reason why and possible explanations.

Our Contract

A legally binding contract between you and SoundArt UK Ltd will be formed when we have sent you an email to confirm that we have despatched the product(s) to you. This email will represent our legal acceptance of the offer that you made to purchase the product(s) when you completed your order. In circumstances where we confirm to you that some of the products you have ordered have been despatched, but not the entire order the items that have not been despatched will not form part of our contract with you. In the event of any change e.g. in price or expected delivery date for the ordered between completion of your order and contract formation, we shall inform you and you will at that point have the right to either (1) accept such change (in which case your email reply will represent a new offer which we will be able to accept upon notification of despatch) or (2) reject such change (in which case your email reply will represent the cancellation of your order, or the relevant part of your order as the case may be).

Data Protection

SoundArt UK Ltd will never make your personal details available to other companies for marketing purposes. We will keep a record of your address details with the intention of sending your order.

Payment

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and SoundArt UK Ltd will not be liable for any delay or non-delivery.

Returns

Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from SoundArtUK.com.

Damaged goods or incorrect deliveries

Our warranty is subject but not limited to the following conditions: (1) the goods must be stored in appropriate conditions; if you do not store them in appropriate conditions we cannot be held responsible for faults or problems that arise as a result; (2) any claim by you in respect of any shortages and/or defects in the goods must be notified to us by you within seven days of the delivery date, stating the nature of the shortage or defect and quoting the invoice no.; failure to notify us as described will deem you to have accepted the goods.

In some cases SoundArt UK Ltd may require you to return the defective goods to SoundArt UK Ltd at its cost, where you have made a valid claim in respect of any shortages or defects and we are liable for the claim. SoundArt UK Ltd will first confirm a valid claim has been made and send you a letter of authorisation to return. Please appropriately package the items with the letter of authorisation and the original invoice. In addition for defective goods we will refund you reasonable costs incurred for postage of the goods, but we shall have no further liability to you. If you do not notify SoundArt UK Ltd accordingly, SoundArt UK Ltd shall have no liability for any defects and you shall be bound to pay for the goods.

Force Majeure

SoundArt UK Ltd shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Limitation of Liability

Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction, however nothing in these terms and conditions shall exclude or limit SoundArt UK Ltd’s liability for death or personal injury as a result of SoundArt UK Ltd’s negligence.

Invalidity of Terms and Conditions

If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be affected.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with English Law and agree to submit to the exclusive jurisdiction of the English courts.
